Acceptance of Terms

By accessing this website or engaging our services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms & Conditions in full.

If you are acting on behalf of another person or organisation, you warrant that you have the authority to bind that party to these terms.

Our Services

Padang Counsel offers the following services to clients in Singapore:

  • Divorce & Separation Counsel โ€” assistance with simplified and contested divorce proceedings, ancillary matters, and asset division.
  • Child Custody & Access Arrangements โ€” advisory and representation for custody, care and control, and access applications.
  • Family Mediation Facilitation โ€” structured mediation sessions for dispute resolution outside the courtroom.

Service availability is subject to our capacity at the time of enquiry. We reserve the right to decline engagements at our discretion, including where conflicts of interest arise.

Engagement Terms

Our professional engagement commences upon issuance of a signed engagement letter or written confirmation from Padang Counsel. Initial consultations may be conducted without a formal engagement being in place.

Important: General information on our website does not constitute legal advice. A formal engagement is required before legal advice is provided in relation to your specific circumstances.

  • Scope of work will be defined in the engagement letter
  • Modifications to scope require written agreement from both parties
  • Each engagement is specific to the client matter described; it does not extend to related matters unless agreed
  • Relocation cases involving children require separate authorisation discussions

User Responsibilities

When engaging with our website or services, you agree to:

  • Provide accurate, complete, and timely information relevant to your matter
  • Notify us promptly of any changes in your circumstances that may affect your matter
  • Respond to our communications within a reasonable timeframe

Fees & Payment

Our current service fees are as follows (indicative starting rates in SGD):

  • Fees are quoted in Singapore Dollars (SGD) and are exclusive of disbursements and court filing fees unless stated
  • Invoices are payable within 14 days of issuance unless agreed otherwise
  • We accept payment by bank transfer, PayNow, or cheque made payable to Padang Counsel
  • Unpaid fees may result in suspension of services until the outstanding amount is settled
  • Disbursements (e.g., court fees, search fees) will be invoiced separately at cost

Refund Policy: Consultation fees paid for initial advisory sessions are non-refundable. For ongoing engagements, fees paid for work already performed will not be refunded. Fees for work not yet commenced may be refunded at our discretion, subject to a reasonable administrative charge.

Confidentiality

We treat all client information as strictly confidential. Information shared with us in connection with your matter will not be disclosed to third parties except as required to carry out your instructions, or as required by law, regulatory obligation, or court order.

Our confidentiality obligations persist beyond the conclusion of your engagement with us. Clients are similarly expected to treat information received from Padang Counsel about our processes, pricing structures, and internal procedures as confidential.

Limitation of Liability

To the extent permitted by Singapore law, Padang Counsel's aggregate liability for any claim arising from your use of this website or our services shall not exceed the fees paid by you to us in the three months preceding the claim.

We shall not be liable for:

  • Loss of data, revenue, or business opportunity
  • Actions or decisions taken on the basis of general website content without formal legal advice
  • Delays or failures resulting from circumstances beyond our reasonable control (force majeure)

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or any other liability that cannot be excluded under Singapore law.

Termination

Either party may terminate a service engagement by providing reasonable written notice. Upon termination:

  • All outstanding fees for work completed become immediately payable
  • We will return client documents and materials held by us, subject to any lien for unpaid fees
  • Our obligation to maintain confidentiality continues beyond termination
  • We will assist with orderly handover to incoming legal counsel where requested

We reserve the right to terminate or suspend services immediately where a client engages in conduct that is unlawful, abusive, or materially inconsistent with these Terms.

Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore.

In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation. If the matter remains unresolved after 30 days, either party may refer the dispute to mediation at the Singapore Mediation Centre (SMC) before pursuing litigation.

The Courts of Singapore shall have non-exclusive jurisdiction over any dispute that cannot be resolved through the above process.

General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, form the complete agreement between the parties regarding the subject matter herein.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in future.
  • Assignment: You may not assign your rights under these Terms without our prior written consent.
  • Notices: Formal notices must be delivered in writing to the address or email contact specified in Section 15.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or applicable laws. Material changes will be reflected by an updated "Last Updated" date at the top of this page.

Continued use of our website or services after such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
